Accepting these terms

These terms form the agreement between you and AV Fashion, Studio 4, Prestige Atrium, 100 Feet Road, Indiranagar, Bengaluru 560038. Browsing avfashion.in, creating an account or placing an order means you accept them.

They should be read alongside our Privacy Policy and our Shipping & Returns policy, both of which are part of this agreement. If you do not accept any part of it, please do not use the site.

Use of the site

You may browse, search, share links and buy for personal, non-commercial purposes. You must be 18 or older to place an order, or have the permission of a parent or guardian who accepts these terms on your behalf.

The information on product pages — measurements, fabric composition, care instructions and delivery estimates — is given in good faith and reviewed regularly. Screens render colour differently, and knitted fabrics carry a tolerance of roughly 1–2 cm on stated measurements, so a small variation from the photograph is normal rather than a fault.

We try to keep the site available at all times, but we may suspend it without notice for maintenance, security work or reasons beyond our control. Availability is not guaranteed and we are not liable for losses caused by downtime.

Accounts

You can shop as a guest, but an account keeps your addresses, wishlist and order history in one place. When you create one you agree to give accurate details, keep your password to yourself, and tell us promptly if you think someone else has access.

One person, one account. Activity under your account is treated as yours, so choose a password you do not reuse elsewhere. We may suspend or close an account that is used for fraud, resale, abuse of staff, or repeated refusal of cash-on-delivery parcels — and we will explain why in writing when we do.

You may close your account at any time by emailing us. Orders already placed still stand, and invoices we are legally obliged to keep will be retained as set out in the Privacy Policy.

Pricing & availability

All prices are in Indian Rupees and include GST. Delivery charges and any cash-on-delivery handling fee are shown separately at checkout before you pay, never added afterwards.

Prices can change at any time, but never after we have accepted your order. Struck-through figures are the manufacturer’s recommended retail price for that item, and discounts are calculated against it.

Stock is shared between this site and our studio, so an item can sell out between your last page load and checkout. Very occasionally a price is published in error — a decimal in the wrong place, a discount applied twice. Where the error is obvious, we are not obliged to sell at that price: we will cancel the affected line, tell you promptly and refund it in full within two working days.

Orders & cancellation

Placing an order is an offer to buy. The contract forms only when we send the dispatch confirmation email — the order acknowledgement you see on screen is a receipt of your request, not our acceptance of it.

We may decline an order where the item is out of stock, the address is not serviceable, payment is not authorised, a pricing error applies, or the quantity suggests resale rather than personal use. Nothing is charged, or everything is refunded, when we decline.

You can cancel free of charge at any point before dispatch — write to us with the order number and we will confirm within a few hours during studio hours. Once the parcel is with the courier, cancellation is no longer possible, but the 30-day return window covers you from the moment it arrives.

Coupon codes are single-use per customer unless stated otherwise, cannot be combined, and have no cash value. If a coupon is used on an order that is later part-returned, the discount is recalculated against the items you keep.

Returns & refunds

Returns are governed by our Shipping & Returns policy: 30 days from delivery, free reverse pickup at most PIN codes, one free size exchange per order, and refunds to the original payment method within two working days of inspection.

Those rights sit on top of, and never replace, the protections given to you by the Consumer Protection Act, 2019 and the Legal Metrology (Packaged Commodities) Rules. Nothing in these terms limits a right you hold under Indian law.

Intellectual property

The AV Fashion name and logo, our garment designs, prints, patterns, photography, illustrations, copy and the design of this site are owned by us or licensed to us, and are protected by Indian and international copyright and trade mark law.

You may share links and screenshots socially, and we love it when you do. You may not copy our photography or product descriptions onto another shop, reproduce our prints on manufactured goods, or use our name in a way that suggests we endorse you, without written permission first.

Reviews & user content

When you post a review, photograph or comment you keep ownership of it, and you grant us a free, worldwide licence to display it on our site and channels alongside the product it describes. You confirm that it is your own work and that anyone identifiable in a photograph has consented.

We publish critical reviews as readily as glowing ones — a three-star review about a tight neckline is more useful to the next parent than silence. We remove content only where it is unlawful, abusive, off-topic, contains personal data, or is a competitor posing as a customer.

Prohibited use

You agree not to:

• Scrape, crawl, mirror or bulk-download the site, its catalogue or its images by any automated means.
• Probe, scan or test the security of the site, or interfere with it through malware or denial-of-service traffic.
• Use stolen payment instruments, or place orders in someone else’s name without their authority.
• Buy for commercial resale, or exploit pricing errors and coupon loopholes at scale.
• Post anything unlawful, obscene, defamatory or hateful, or impersonate another person.
• Abuse, threaten or harass our team. They are people, and they are answering you personally.

We may restrict access, cancel orders or close accounts where any of this occurs, and report serious cases to the authorities.

Liability

We stand behind what we make. Where an item is faulty, mis-described or never arrives, we repair, replace or refund it as set out in our returns policy.

Beyond that, and to the extent Indian law permits, our total liability for any claim connected with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses — a missed party, a lost opportunity, loss of profit or goodwill — nor for delays caused by events outside our reasonable control, including courier strikes, floods, civil unrest and network failures.

Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Governing law & jurisdiction

These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising from them or from an order placed on this site.

Before anyone reaches a courtroom, please write to us. Almost everything is resolved by an email and a replacement parcel. If we cannot agree within 30 days, either of us may refer the matter to mediation in Bengaluru, in English, with the cost shared equally.

If any clause of these terms is found unenforceable, the rest continues in force.

Changes to these terms

We may update these terms as the business changes. The version published here on the day you place an order is the version that governs it, so a later change never applies retrospectively to a completed purchase.

Material changes are announced on this page with a revised date and notified to account holders by email at least seven days before they take effect.
